Article 1: Purpose

These terms of use specify the conditions under which the website Cosplay-it.com makes its services available. Any use of the website Cosplay-it.com implies acceptance of and compliance with the entirety of the conditions set out in these terms of use.

These terms are binding in the same manner as a contract between the service and the user. These terms of service are applicable to the entirety of the website www.cosplay-it.com, its pages, and content, with no restrictions or reservations.

When accessing or using the website as a professional, you are guaranteeing anonymation - Studio de création that you own all rights, authorizations and necessary proxies to accept these terms of use on behalf of the company, association, partner or any other entity for which you are using the site and/or creating an account, in following with the stipulations hereunder. If you do not agree with the provisions as detailed below, we request you refrain from using the site.

Article 2: Description of services

Cosplay-it.com is a free hosting website particularly dedicated to Cosplay, allowing the user to view, access, upload, store, share and comment on their personal images.

The creation of a basic account guarantees an account with public and private options, as well as access to the “classic” or “costume” gallery creation service, and the creation of online tutorials.

Each user is allotted storage space limited to 1Go, so as to control bandwidth costs. As the website is not designed to store pictures, the user is responsible for taking the necessary precautions towards this end. Finally, in accordance with habitual online practices and norms, advertisements may be integrated into the website

Article 3: Accessing services

Accessing the services provided by the website is free for an user with internet access. Some parts of the website and certain features are reserved for our members after identification via username and password.

anonymation - Studio de création does everything in its power to ensure the best quality of its services. However, anonymation - Studio de Creation will be held to no obligation of succeeding in this task, and will not be responsible for any prejudice resulting from interruption of its services.

anonymation - Studio de création reserves the right to refuse access to the website, unilaterally and without prior notice, to any user who does not respect these terms of service.

anonymation - Studio de Creation reserves the right to interrupt, momentarily suspend or alter/modify access to all or parts of the website without prior warning, to carry out maintenance or for any other reason, with said interruption providing no grounds for any obligation or compensation.

Article 4: Intellectual property

If you are the holder of an account on the Cosplay-it.com website, through which you use the wesbite’s various services, i.e. adding pictures, uploading tutorials, uploading avatars, Cosplay-it.com holds no rights to your content, save for the right to self-promotion, as defined in article 12. From the moment you make content public to other users, you declare that you accept they can freely view and share your content on the website, for all the time that said content is hosted on Cosplay-it.com.

The user is solely responsible for the user content they upload online via the website, as well as any texts and/or opinions they may share. If the user is not the owner of the content published online via the website, they must have authorisation from the lawful owner of said content. The user guarantees that this data is not of a nature to harm the legitimate interests of any third parties. In this capacity, the user safeguards anonymation - Studio de Creation against any claims, based directly or indirectly on these comments and/or data, liable to be brought by whomever against anonymation - Studio de Creation. The user in particular pledges to pay any sums that may be incurred as a result of any third party claims against anonymation - Studio de Creation, including legal costs and attorney fees.

anonymation - Studio de Creation renounces any commercial exploitation of the content uploaded online by the users, except in the event of a written agreement, including via email, that includes all rightful claimants to said content.

We will not be held responsible for any misappropriation or piracy of user content passing through the site.

anonymation - Studio de Creation reserves the right to delete part or all of user content, at any time and for any reason, without prior notice or explanation. In this capacity, users will not be able to bring forward any claim, on any grounds.

Article 5: Content

anonymation - Studio de Creation has no legal obligation to monitor content transmitted through or stored on the website. As a hosting site, an easily accessible and visible feature allows users to report any content related to/relative to:

Pornography
Child pornography
Incitation to racial hatred
Extolling crimes against humanity
Violence or incitement to violence
Defamation/libel and image rights
Invasion of privacy

Any illicit content reported to anonymation - Studio de Creation will be immediately removed from the website.
Users may report any content protected by intellectual property rights via the same process.

Article 7: Limitations and exclusions of liability

The Cosplay-it.com website is a cosplay-related content sharing website.

anonymation - Studio de Creation cannot guarantee the accuracy or relevance of the material on this website. Moreover, the information displayed on the site is purely for information purposes and cannot be considered to be advice or recommendations of any nature.
Therefore, the use of the data and content available on the website will in no way be the responsibility of anonymation - Studio de Creation in any capacity. The user is solely responsible for the correct and selective usage of the information put at their disposal on the website.
Moreover, the user guarantees they will compensate anonymation - Studio de Creation for any prejudicial consequences directly or indirectly linked to their usage of the service.

Access to certain parts of the Cosplay-it.com website necessitates the use of a user name and password. This password, chosen by the user, is personal and confidential. The user guarantees they will keep their password secret and will not divulge it in any way. Using one’s user name and password online is done at one’s own risk and peril; it behooves the user to take all necessary precautions to safeguard their personal data against any breach.

The terms of service must be understood in the broadest sense, that is any usage of the site whatsoever, legal or not.
The user pledges to comply with all regulations in force in France.

Cosplay-it.com offers hyperlinks towards websites edited and managed by third parties.
Inasmuch as no control is exerted over these external resources, the user admits that anonymation - Studio de Creation assumes no responsibility related to the resources made available, and cannot be held responsible as to their content.

Article 9: In case of force majeure

In case of force majeure or in the case of separate events, anonymation - Studio de Creation may not be held liable.

Article 10 : Amendments to the current terms of service

anonymation - Studio de Creation reserves the right to modify the terms, conditions or indications of the current terms of service at any time.
It is recommended that the user regularly consult the latest version of the terms of service, available when clicking on the “Legal” button on the website www.cosplay-it.com.

Article 11: Validity and termination

The present terms of use are valid for an indeterminate duration, starting from the beginning of the use of the service. If you violate these terms of service, we may restrict your access to part or all of cosplay-it.com.
You will be warned via email or when you next attempt to access your account. If you would like to delete your account, please notify us at contact@cosplay-it.com or via mail at the address supplied in our Legal Notice page.

Article 12: Applicable law and competent jurisdiction

The rules applicable to the content and the exchange of data in and around the website are determined by French law.
In the event of litigation, in which no out-of-court settlement was possible, only French courts under the jurisdiction of the Paris Court of Appeal will be qualified to address the issue.

Article 13: Our intellectual property

The website is our sole property. Under condition of acceptance of the Terms of Service, we grant free, personal and non-exclusive rights to access and use the website.
The content (excluding your content and that of other users) included and accessible on/via the website (text, logos, brand, features) is the sole property of anonymation - Studio de Creation and protected by intellectual property rights.
Users of the Cosplay-it website hereby authorize anonymation - Studio de Creation to use the content they publish online for the non-commercial promotional purposes of anonymation - Studio de Creation, without time limitations, and on any medium whatsoever.

1 : Introduction

Scope:
Children under 13 years old:
Children under 13 years old may not sign up to the website or give us any of their personal data. If we are made aware of any information pertaining to a child under 13, we will delete all said information as soon as possible.
If you believe you have come across data pertaining to a child under 13 years old, please contact us.

Parental authorisation :
We strongly recommend that minors 13 years old and above ask for authorisation from their parents before giving anyone their personal information online, and we encourage parents to make their children aware of safe ways of using the internet.

Transfers in case of sales or changes in ownership:
If our website were ever to change owners, your data may be transferred to the new owner so that the site may continue operating. If applicable, your data will remain subject to the commitments made in any pre-existent privacy policy..

2 : Data

“Data” refers to all the personal information you will voluntarily provide anonymation - Studio de Creation when creating a user account on our website.

We will then proceed to deactivate or terminate your account in compliance with your request.
When an account is deactivated, it can no longer be seen by any user, but has not been deleted. We retain your profile information (connections, photos, etc.) in case you decide to reactivate your account later on.
You may at any moment request the reactivation of your account and the complete restoration of your profile.
When you request that we terminate an account, it is deleted permanently from our website. Please only terminate your account if you are certain of never wanting to reactivate it.

Termination-related restrictions:
Even after having deleted information from your profile or terminating your account, copies of your information may remain visible, insofar as they have been shared with other users, or distributed, copied or saved by other users. However, your name will no longer be linked to these informations on our website.

3 : Purposes of data processing

Data is collected honestly and legally, and only processed in the setting of the purposes defined hereunder, and more generally to comply with applicable legislation relative to Internet technical service contractors.

Rights of access, rectification, veto and erasure of their data, to use their data for direct marketing purposes, and to any data processing for any legitimate reason.
Those responsible for the data processing commit to dealing with information and veto requests that have been sent to them directly or indirectly as quick as possible.
Right to oblivion
One may not store identifying data for any longer than the period of time during which said data is necessary to the achievement of the intended purpose.

This data is necessary in order to create and manage your account, and to allow you to use our websites’ various features, such as the addition of galleries, cosplays, pictures, videos and tutorials, as well as to comment and save content.
It also allows us to offer personalised services and features, as well as evaluate and improve said services and features and offer a fitting customer experience. We use this data to prevent possible illegal activity and to enforce our terms of service.

We do not use your email address or any other information that may identify you personally without your active consent, except within the framework of a specific program or feature that you can activate or block. We may however use your email address, for instance to send you notification emails concerning the website.

Therefore we require a password when you open an account, which will protect your account against all unauthorized access. You are responsible for the safe usage of your password as well as for keeping it secret.

6 : Data retention

Data is stored on the anonymation - Studio de création servers, and are stored only for the duration necessary for you to use your account. However, you are hereby informed that when your account is deactivated for any reason whatsoever, the associated data and content (e.g. photos, descriptions, avatars, etc.) will be stored for a period of six months after your account is deactivated. Beyond this time period, data and content will be deleted from our servers and your username will be freely available to other internet users who wish to set up an account on our website.

7 : Your rights

anonymation - Studio de Creation hereby lets you know that you have the right to access, modify and delete your data under the current applicable legal framework. You may at any time access and modify the informations linked to your profile online from the “profile settings” pages in your account. In compliance with article 38 of Act no.78 of 6 January 1987 on Information Technology, Data Files and Civil Liberties, you have the right to access, modify and delete your data by contacting us via mail as seen in the “Legal Notice” section.

8 : Updates

We reserve the right to modify our privacy policy in accordance with the procedures detailed in our website’s Terms of service. Save indication to the contrary, our privacy policy is applicable to all information we have about you and your account. The updates made to our privacy policy will be in blue and at the top of the page.

Actions and activities for any commercial purpose are strictly prohibited (e.g.: selling photos, selling costumes, canvassing etc..). Titles written entirely in uppercase are not allowed.

Photos

Only photos relating to cosplay are allowed.
Meaning:

Costume (Cosplays) photos
Photos illustrating the stages of creation of a costume (Cosplay)
Photos of cosplay events
Reference images of the model used in the creation of a costume (Cosplay)

Galeries

Galleries content must be different from a singular costume.
A gallery containing pictures of one single cosplayer is liable to moderation.
Classic galleries containing only illustrations of users' future projected are allowed.

Text-based content

Any text-based content that is vulgar, racist, inciting hatred, suicide or pedophilia is forbidden.

The moderation team reserves the right to act upon all content that does not abide by the terms and conditions and the regulations of the website.
